These Product Terms and Conditions (these “Product Terms”) apply to all quotes and purchases of products or services provided by Just Right Reader, Inc. a Delaware corporation (“Just Right Reader”, “Company”, “we”, “our”), whether purchased from the Just Right Reader website (the “Site”) or directly through completing a purchase order form, or otherwise (“Just Right Reader Products” or “Products”). Each quote and subsequent purchase thereof incorporate these Product Terms in its entirety. If you used or purchased a product or service from the Just Right Reader Site, these Product Terms and Conditions supplement the Just Right Reader Terms and Conditions. If any term or provision in any quote or the Just Right Reader Terms and Conditions modifies or conflicts with these Product Terms, these Product Terms shall control. Provisions in a quote that are in addition to or different from these Product Terms shall not become part of these Product Terms.
These Product Terms and any purchase order form, the Just Right Reader Terms and Conditions, and any other terms and conditions or policies or guidelines provided by Just Right Reader when purchasing Just Right Reader Products form a legally binding agreement made by and between you and Just Right Reader. Please read these Product Terms before purchasing any Just Right Reader Products. By purchasing any Just Right Reader Products, you agree to be bound by these Product Terms. If you do not agree to be bound by these Product Terms, you may not purchase Just Right Reader Products.
Not for Resale
Just Right Reader Products are intended for purchase by end users. Just Right Reader products may not be resold or ordered for resale unless you have entered into a separate written reseller agreement with the Company.
You may place orders and make purchases of Just Right Reader products (i) by placing an order directly from the Site, (ii) by completing a purchase order form, or (iii) as otherwise communicated directly to you by a representative of Just Right Reader. When placing an order to purchase any Just Right Reader Products, you acknowledge that it will be deemed an offer to purchase the products you select, expressly subject to these Product Terms. While it is our practice to confirm orders either by email or otherwise, the receipt of an email order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell a Product. We reserve the right, without prior notice, to limit the order quantity on any Product, to reject any order, and/or to cancel any order at any time. We may require verification of information prior to the acceptance and/or shipment of any order.
If you wish to place an order for Products, you may be asked to supply certain registration information relevant to your order including, without limitation, your name, your email, your phone number, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
By placing an order for Just Right Reader Products, you agree to pay all prices, together with all applicable fees, charges, and taxes as displayed during the checkout process or indicated to you in your quote or otherwise by a representative of Just Right Reader, including fees for delivery, service fees, shipping and handling charges, and government mandated fees (such as delivery surcharges).
You represent and warrant that: (i) you are the holder of and have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any order from Just Right Reader; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to payment processing third parties for purposes of facilitating the fulfillment of your order.
We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to:
We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
The Company reserves the right to revise its prices at any time without notice. The price charged for an item will be the price in effect at the time the order is placed. Price increases will only apply to orders placed after such changes. Posted prices on the Site do not include taxes, and all applicable taxes will be added during the checkout process.
Payment may be made by credit card, ACH, or check.
Just Right Reader will process payments for orders placed on our Site in accordance with the Online Payments Section of the Just Right Reader Terms and Conditions.
Payment must be received by us before we will accept and process an order. We will not be liable for any shipping delays related to non-payment of an order.
We understand the importance of ensuring that our educational materials meet the unique needs of your students and educators. We aim to provide you with high-quality resources that support literacy and foster a love for reading. If you need to return your purchase, you may be able to do as follows:
Items eligible for return must be unused, in their original packaging, and in the same condition as when received.
In order to process a return you may reach out to our Customer Support team via email at support@justrightreader.com or call us at (877) 415-7323. You will be required to provide your order number and a brief explanation of your reason for return.
Our team will review your request and, upon determination of eligibility for return, we will provide you with detailed return instructions.
You are responsible for covering the cost of return shipping to us. Send the package to the address provided in the return instructions. We recommend using a trackable shipping method to ensure safe delivery.
Once your return is received and inspected, we will initiate the refund process.
For Classroom Library purchases, a restocking fee of 15% of the item's purchase price will be deducted from the refund amount. Due to the increased handling required for Take-Home orders, Take-Home restocking fees are 30%.
Exchanges
If you need to exchange an item for a different Product, please follow the return process and request an exchange. Our team is happy to assist you with this process to ensure a smooth transition.
Damaged or Defective Items
If you receive an incorrect, damaged, or defective item, please contact us immediately. We will arrange for a replacement at no additional cost to you.
Unfortunately, we cannot guarantee a certain delivery date or time frame for delivery for any order. Anticipated shipping dates or delivery times are estimates. For orders with specific deadlines, please order well in advance, and we will do everything we can to meet your needs.
Proprietary Rights
You acknowledge that the Just Right Reader Products contain certain content (such as text, graphics, photographs, video, audio, code, and other data or information relating to any subject) (“Content”) that is protected by copyrights, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereinafter developed. All Content is or may be copyrighted as a collective work under the U.S. copyright laws, and Just Right Reader owns a copyright in the selection, coordination, arrangement, and enhancement of such Content on the Just Right Reader Products and any Just Right Reader services. You may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any such Content, in whole or in part. If no specific restrictions are displayed, you may digitally share select portions of the Content, provided that the copies are made only for your personal use and that you maintain any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. Except as provided in the preceding sentence or as permitted by the fair use privilege under the U.S. copyright laws (see, e.g., 17 U.S.C. Section 107), you may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of Just Right Reader.
Product Disclaimer
JUST RIGHT READER MAKES NO EXPRESS OR IMPLIED REPRESENTATION OR WARRANTY OF ANY KIND REGARDING THE PRODUCTS, WHETHER AS TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY OTHER MATTER.
UNDER NO CIRCUMSTANCES WILL OUR LIABILITY UNDER THIS AGREEMENT EXCEED THE PURCHASE PRICE YOU PAID FOR THE JUST RIGHT READER PRODUCTS THAT GAVE RISE TO YOUR CLAIM. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY COST TO PROCURE SUBSTITUTE PRODUCTS, OR ANY INTANGIBLE LOSS, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE JUST RIGHT READER PRODUCTS, OR ANY SERVICE PROVIDED TO YOU BY THE COMPANY.
Applicable Law and Jurisdiction
If a dispute arises between you and Just Right Reader, our goal is to provide you with a neutral and cost-effective means of resolving the issue quickly. In the event of a dispute, we encourage you to contact us first to resolve your problem directly with us as provided in the “Contact us” section below in these Product Terms.
These Product Terms shall be construed in accordance with and governed by the laws of the United States and the State of Texas, without reference to their rules regarding conflicts of law.
ANY DISPUTE, CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE PRODUCT TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION OR VALIDITY THEREOF, INCLUDING THE DETERMINATION OF THE SCOPE OR APPLICABILITY OF THESE PRODUCT TERMS, SHALL BE DETERMINED BY ARBITRATION IN DALLAS COUNTY, TEXAS BEFORE ONE OR MORE NEUTRAL ARBITRATOR(S). THE ARBITRATION SHALL BE ADMINISTERED BY JAMS PURSUANT TO ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES AND IN ACCORDANCE WITH THE EXPEDITED PROCEDURES IN THOSE RULES OR PURSUANT TO JAMS’ STREAMLINED ARBITRATION RULES AND PROCEDURES. JUDGMENT ON THE AWARD MAY BE ENTERED IN ANY COURT HAVING JURISDICTION. THIS CLAUSE SHALL NOT PRECLUDE THE PARTIES FROM SEEKING EQUITABLE REMEDIES FROM A COURT OF COMPETENT JURISDICTION.
Complete Agreement
These Product Terms constitute the entire agreement between you and Just Right Reader with respect to the purchase of the Just Right Reader Products. Your use of the Just Right Reader Site is also subject to the Just Right Reader Terms and Conditions and the Just Right Reader Privacy Policy. If any provision of these Product Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions, which shall remain in full force and effect. No waiver of any of these Product Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
